BUYER

The user or user who visits the Web and registers by entering their personal data in the order form or is registered as a regular user, after acceptance of these General Conditions of Contract (hereinafter CGC), is considered BUYER which can also be identified as “Buyer” and / or “User”.

Also, to use this online shopping service, the User must have the age of majority established in accordance with Spanish law.

Thus, the parties (Seller and Buyer) expressly accept, without reservation, the provisions of these CGCs. 2. APPLICABLE LEGISLATION

Likewise, all personal data provided by the BUYER during the product acquisition process are treated by CANAM HEMP & HEALTH in accordance with Organic Law 3/2018, of December 5, on the Protection of Personal Data and guarantee of digital rights (“LOPD”), as well as Regulation (EU) 2016/679 of the European Parliament and of the Council, of April 27, 2016, concerning the protection of natural persons with regard to the processing of personal and free data circulation of this data (“GDPR”), being able to obtain complete information on uses and rights in the section “Privacy Policy and Legal Notice” of our website.

3. OBJECT

The Seller is preferably engaged in the wholesale and retail sale of hemp seeds and products derived from them.

The acquisition of any of the products in www.canamhemphealth.com, implies acceptance as user, without reservations of any kind, of each and every one of the CGC, of ​​the General Conditions of Use of the Portal (Privacy Policy and Legal Notice , as well as Cookies Policy), in addition to those Particular Conditions that, if applicable, govern said acquisition.

4. LANGUAGE

6. PRODUCT ACQUISITION

7.4. Taxes The corresponding VAT rate is included in the prices of the products. 8. SENDING THE ORDER

CANAM HEMP & HEALTH disclaims all liability in cases where it exceeds the period established by fortuitous event, force majeure or by third parties outside CANAM HEMP & HEALTH.

Orders will always be made through an external transport agency to CANAM HEMP & HEALTH and will be sent directly to the shipping address indicated in the order form.

CANAM HEMP & HEALTH reserves the right to vary the type of shipment and the agency by which it is made, regardless of what is stated in these conditions, and provided that it does not entail manifest damage to the customer.

At the time of delivery, if the customer finds anomalies due to the transport and is not satisfied, he must indicate it inexcusably on the delivery note provided by the assigned transport company, indicating the anomalies found upon receipt of this. At this time of receipt, the user must write down “that he has received it with damages”. If no entry appears in the delivery receipt, the “good condition” of the product is taken for granted and your claim cannot be satisfactorily addressed.

The standard of the freight industry to resolve a claim is 8-12 weeks. The Company aims to ensure that all claims are resolved within a maximum period of 90 business days from the presentation of the complete file.

The described delivery period will be effective in the event that the customer is located at the place of delivery during that period, in which case the products will be understood as delivered on the date on which CANAM HEMP & HEALTH makes them available at The place of delivery.

The order will be canceled and returned to our facilities in cases of attempted delivery frustrated by the fault of the customer for which the transport agency cannot take care of the order until the customer withdraws it. The expenses that suppose the frustrated attempt of delivery attributable to the client will be in charge of this one.

 

9. GUARANTEES AND RIGHT OF WITHDRAWAL

9.1. Warranty

CANAM HEMP & HEALTH states that the products it sells have the highest quality assurance, as well as having their legally recognized warranty terms.

9.2. Right of withdrawal

 

In accordance with the provisions of Royal Legislative Decree 1/2007, of November 16, which approves the consolidated text of the General Law for the Defense of Consumers and Users and other complementary laws, then informs Users of the following aspects:

The client will have a period of 14 calendar days to resolve the sale, provided that the nature of the property acquired allows it. This period will be calculated upon receipt by the customer of the purchased goods.

It will be understood that the customer has known the right of withdrawal from the formalization of purchase of any product, which requires the reading and acceptance of these CGCs, and in any case from the moment you place the order. This right of withdrawal will not apply to those personalized products or that for reasons of hygiene or other legally contemplated exceptions are not subject to withdrawal.

Returns of orders must be sent to the address we indicate after contacting CANAM HEMP & HEALTH. All returns must be previously authorized by CANAM HEMP & HEALTH. To do this, send us an email indicating the reasons for the return and we will contact you to manage it as soon as possible.

The refund of the purchase will be made, in any case, upon receipt of the items in CANAM HEMP & HEALTH. After checking the condition of the merchandise, which must be unused and in its original packaging, the amount will be refunded (shipping costs not included) through a bank transfer to the account indicated previously.

In the event that in a return the item is not in the aforementioned conditions, that is, that it has been given a use that does not correspond to the normal use of the same, it will be sent back to the customer, also charging the postage corresponding.

In any case, CANAM HEMP & HEALTH will not be liable in case of unavailability of the product or impossibility of delivery due to force majeure, theft or loss of coupons or error in the order or data provided by the user.
